LK Advani get relief in Babri Masjid demolition case

In a major relief to L K Advani and 20 others in the Babri Masjid demolition case, the Allahabad High Court has rejected CBI's petition to revive criminal conspiracy charges against them. However, the case against them for inflammatory and provocative speeches will continue at Rae Bareli. In his 44-page judgement, Justice Alok Kumar Singh of the Lucknow bench of the High Court said there was no merit in CBI's revision petition challenging the 4th May 2001 order of the special court which directed dropping of criminal conspiracy charge against BJP leaders Advani and Murli Manohar Joshi, besides Uma Bharti, former UP chief minister Kalyan Singh and others.
There are two sets of cases -- one against Advani and others who were on the dias at Ram Katha Kunj in Ayodhya on December six, 1992 when the Babri Masjid was demolished. While the other case was against lakhs of unknown 'kar sevaks' who were in and around the disputed structure. Upholding the 2001 order, Justice Singh said, "Nothing is found against the correctness, legality, propriety or regularity in respect of any of the findings of the lower court." He said Advani and 20 others were present on the dias at Ram Katha Kunj on the first floor of the building, "holding meeting, giving speeches and raising slogans." All the 21 were charged under sections 153A IPC (promoting enemity betwen classes), 153B (imputations, assertions prejudicial to national integration) and 505 (false statements, rumours etc circulated with the intent to cause mutiny or disturb public peace). Among the accused were -- Balasaheb Thackeray, Ashok Singhal, Giriraj Kishore, Vinay Katiyar, Sadhvi Rithambara, Vishnu Hari Dalmiya, Mahant Avaidhya Nath and Ram Vilas Vedanti.
