Rajasthan High Court stays Gujjar reservation of 5% under SBC

Rajasthan High Court stays Gujjar reservation of 5% under the Special Backward Classes (SBC) category  till February 19 in state services and educational institutions. The state government had decided on November 29 last year to award five per cent reservation to Gujjars, Raika, Banjaaras, Gadiyalohar and Gadariya communities as special backward class, taking the total reservation in the state to 54 percent. The PIL that challenged the decision of state government to implement the reservation, which was to come into effect from January 30, was filed by one Mukesh Solanki.
Taking cognizance of the letter written by some students, the division bench of Chief Justice Jagdish Bhalla and Justice M N Bhandari observed that the reservation provided to Gujjars and economically weaker sections by the state government does not comply with the legal provisions given the Supreme Court order on it. The court has sought reply from the government in this regard within 15-days. It is to be noted that the state government had passed a bill providing for 5 percent and 14 percent reservation for Gujjars and economically weaker sections.
